利用規約（EULA）
本利用規約（以下「本規約」）は、お客様と「Osugata（御姿）」（以下「本アプリ」）の開発者（以下「当方」）との間のエンドユーザーライセンス契約（EULA）です。本アプリをダウンロードまたは使用した時点で、本規約に同意したものとみなされます。本規約はAppleの標準EULA（Licensed Application End User License Agreement）を基礎としており、本規約に定めのない事項についてはAppleの標準EULAが適用されます。
1. ライセンス
当方は、App Store利用規約で認められる範囲において、お客様が所有または管理するApple製デバイス上で本アプリを使用するための、個人的・非独占的・譲渡不能・取消可能なライセンスをお客様に付与します。法令で認められる場合を除き、本アプリの複製、改変、リバースエンジニアリング、再配布、転売はできません。
2. 利用できる写真と禁止事項
本アプリで仕立ててよいのは、お客様が利用の許諾を得ている写真に限られます。ご自身、またはご家族など、お客様が利用してよい写真をお選びください。第三者の肖像を含む写真を、その方（またはその権利を持つ方）の同意なく利用しないでください。
お客様は、本アプリを用いて以下の行為を行わないことに同意します。
- 第三者の肖像、または故人の肖像を、権利を持つ方の同意なく利用すること（特に商用目的での無断利用）。
- 他人へのなりすまし、または実在の人物について事実と異なる印象を与える表現の作成。
- 他人の名誉・信用を毀損し、または侮辱・中傷する目的での利用。
- 性的・わいせつなコンテンツの作成。
- 法令、公序良俗、または第三者の権利（肖像権・著作権・プライバシー等）を侵害する利用。
故人・ご遺族への配慮: 本アプリは、大切な方のお姿を尊厳をもって扱うために設計されています。故人の写真を扱う際は、ご遺族をはじめ関係する方々の心情に配慮し、故人の尊厳を損なうような利用を行わないでください。
3. 編集する範囲と、行わないこと
本アプリが整えるのは構図・背景・明るさのみです。顔や肌の加工、衣装（礼服等）の生成・合成、表情の変更は行いません。その人のお姿を作り変えるのではなく、遺影としての体裁にていねいに整えることを目的としています。
衣装の生成・合成を行わないのは、①故人を作り変えないという尊厳の維持、②合成した衣装の破綻が遺影では致命的になりうること、③実際とは異なる印象を与えないこと、を理由とする設計上の方針です。
背景の差し替えについて: 背景を無地に差し替える機能は、おひとりで写っている写真を対象とします。集合写真や、被写体と背景の境目が判別しづらい写真（低コントラスト・重なり・和装の襟や袖・スキャンの折れなど）では、切り抜きの品質を保てないことがあります。その場合、本アプリは元の背景のままにすることをおすすめし、無理な差し替えを行いません。これは仕上がりと故人の尊厳を守るための挙動です。
4. 印刷・サイズ規格に関する免責
本アプリは、四つ切（254×305mm）・A4・2L・L判・デジタル遺影（16:9 / 4:3）などのサイズで、印刷に適した300dpiのデータを書き出します。ただし、実際の印刷の可否・仕上がりは、印刷方法や機器によって異なります。
印刷所・葬儀社・斎場の受け入れ規格（サイズ・余白・光沢の可否・データ形式など）は、事前にご確認ください。本アプリは印刷やその品質を約束するものではなく、書き出したデータの印刷・入稿はお客様ご自身の責任で行うものとします。コンビニ印刷はL判・2Lが中心となり、四つ切・A4の光沢印刷はネット印刷・写真店をご利用ください（アプリ内に手順ガイドがあります）。
5. 課金・購入
- 本アプリは、AppleのApp Storeを通じて、消耗型の課金アイテム「1枚仕上げ（全サイズ込み）」（¥680 / $4.99）と、非消耗型（買い切り）の「無制限プラン」（¥1,800 / $11.99・書き出し無制限）を提供します。サブスクリプション（自動更新）は提供していません。価格は購入前にアプリ内に表示されます。
- 1クレジット＝1枚の写真の全サイズ書き出し: 消耗型のクレジット1つで、選んだ1枚の写真を、四つ切・A4・2L・L判・デジタル遺影のどのサイズでも書き出せます。サイズごとに追加課金は発生しません。
- 同一写真の再書き出し: クレジットを消費した写真は、同じ写真であれば、あとから別のサイズで書き出し直しても追加料金はかかりません（クレジットは写真の識別情報に紐づけて端末内の台帳に記録されます）。別の写真を仕上げる場合は、新たにクレジットが必要です（または無制限プラン）。
- 消耗型クレジットの引き継ぎについて: 消耗型クレジットは端末内のKeychainに保存され、Appleの消耗型アイテムの仕組み上、同一端末での再インストールには耐えますが、機種変更では引き継がれません。また「購入の復元」の対象にもなりません。機種変更・端末の移行の前に、お手持ちのクレジットは使い切ることをおすすめします。
- 無制限プランの復元について: 「購入を復元」で復元されるのは非消耗型の無制限プラン（¥1,800 / $11.99）のみです。同じApple Accountであれば、機種変更後や再インストール後も復元できます。
- 返金について: 決済および返金の手続きはすべてAppleが取り扱い、当方独自のポリシーはなく、Appleのポリシーに従います。当方側で返金を行うことはできません。返金のお申し出はAppleのreportaproblem.apple.comから行ってください。
6. プライバシー
本アプリは写真を含むいかなるデータも収集しません。すべての処理は端末内で完結します。詳細はプライバシーポリシーをご覧ください。
7. 担保の否認
本アプリは「現状有姿（AS IS）」かつ「提供可能な状態（AS AVAILABLE）」で提供されます。当方は、商品性、特定目的への適合性、権利非侵害を含め、明示・黙示を問わず、本アプリに関するいかなる担保もいたしません。本アプリが中断なくエラーなく動作すること、切り抜きや構図の結果が常に意図どおりになること、および書き出したデータがあらゆる印刷環境で問題なく印刷できることを、当方は約束するものではありません。
8. 責任の制限
適用法令が許容する最大限の範囲で、当方は、間接損害、付随的損害、特別損害、結果的損害、懲罰的損害その他本アプリの使用または使用不能から生じる損失について、責任を負いません。当方の責任の総額は、請求に先立つ12か月間にお客様が本アプリに対して支払った金額を上限とします。ただし、消費者契約法その他の強行法規により制限できない責任については、この限りではありません。
9. 本アプリおよび本規約の変更
当方は、本アプリおよび本規約を随時更新することがあります。重要な変更は、本ページに掲載し、制定日（改定日）を更新することでお知らせします。変更後に本アプリの使用を継続した場合、変更に同意したものとみなされます。
10. 準拠法・管轄
本規約は日本法に準拠し、日本法に従って解釈されます。本規約に関する紛争については、消費者保護に関する強行法規の定めがある場合を除き、日本の裁判所を専属的合意管轄裁判所とします。
11. Appleが第三受益者であること
AppleおよびAppleの子会社は本規約の第三受益者であり、本規約を執行する権利を有することにお客様は同意します。Appleは本アプリに関する保守・サポートを提供する義務を負いません。サポートは当方が提供します（下記参照）。

Terms of Use (EULA)
These Terms of Use ("Terms") are an end user license agreement (EULA) between you and the developer of Osugata ("Osugata," "the app," "we," "us"). By downloading or using the app, you agree to these Terms. These Terms are based on, and incorporate the protections of, Apple's standard Licensed Application End User License Agreement; where these Terms are silent, Apple's standard EULA applies.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Osugata on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, distribute, or resell the app except as permitted by law.
2. Photos You May Use, and Prohibited Uses
You may only prepare photos that you are permitted to use. Choose photos of yourself or your family that you have the right to use. Do not use a photo containing someone else's likeness without the consent of that person (or of the rights holder).
You agree not to use the app to:
- use another person's likeness, or a deceased person's likeness, without the consent of the rights holder (in particular, for commercial purposes);
- impersonate another person, or create a misleading impression of a real person;
- defame, insult, or harm the reputation of another person;
- create sexual or obscene content;
- infringe any law, public order, or the rights of others (including portrait rights, copyright, and privacy).
Respect for the deceased and their families: This app is designed to treat a loved one's likeness with dignity. When working with a photograph of someone who has passed away, please be considerate of their family and others close to them, and do not use the photo in any way that would diminish that person's dignity.
3. What the App Edits — and What It Does Not
The app adjusts only composition, background, and brightness. It does not retouch faces or skin, generate or composite clothing (such as formal attire), or change expressions. The aim is to prepare a dignified memorial portrait, not to remake the person.
We do not generate or composite clothing by design, for three reasons: (1) preserving dignity by not remaking the deceased; (2) composited clothing can break in ways that are unacceptable for a memorial portrait; and (3) avoiding an impression that differs from reality.
About background replacement: Replacing the background with a solid color is intended for photos of a single subject. For group photos, or photos where the subject and background are hard to separate (low contrast, overlap, the collar or sleeves of traditional dress, a fold in a scan, and so on), segmentation quality may be insufficient. In those cases the app recommends keeping the original background rather than forcing a replacement. This behavior protects both the result and the dignity of the portrait.
4. Printing and Size Requirements Disclaimer
The app exports print-ready 300dpi files in sizes such as 254×305mm, A4, 2L, L, and digital memorial formats (16:9 / 4:3). Whether and how a file actually prints depends on the printing method and equipment.
Please confirm the acceptance requirements of your print shop, funeral home, or ceremony hall (size, margins, whether glossy stock is allowed, file format, and so on) in advance. The app does not guarantee printing or its quality; printing and submitting the exported data are your own responsibility. Convenience-store printing is mainly for L and 2L sizes; for glossy 254×305mm or A4, please use an online print service or a photo shop (a step-by-step guide is provided in the app).
5. Purchases
- Through Apple's App Store, the app offers a consumable purchase, "one portrait, all sizes" (¥680 / $4.99), and a non-consumable (one-time) "Unlimited plan" (¥1,800 / $11.99, unlimited exports). There is no subscription and no auto-renewal. Prices are shown in the app before purchase.
- One credit = all sizes of one photo: A single consumable credit lets you export the chosen photo in any size — 254×305mm, A4, 2L, L, or digital. There is no additional charge per size.
- Re-exporting the same photo: Once a credit has been used on a photo, you can re-export that same photo in a different size later at no additional charge (the credit is recorded in the on-device ledger, linked to the photo's identifier). Preparing a different photo requires a new credit (or the Unlimited plan).
- Carrying consumable credits over: Consumable credits are stored in the device Keychain. Under Apple's consumable-purchase model, they survive a reinstall on the same device but are not carried over to a new device, and they cannot be recovered with "Restore Purchases." We recommend using up any remaining credits before switching or migrating devices.
- Restoring the Unlimited plan: "Restore Purchases" restores only the non-consumable Unlimited plan (¥1,800 / $11.99). With the same Apple Account, it can be restored after switching devices or reinstalling.
- Refunds: All billing and refunds are handled by Apple, according to Apple's own policy — we have no separate refund policy and cannot issue refunds ourselves. Refund requests are made to Apple at reportaproblem.apple.com.
6. Privacy
Osugata collects no data, including no photo data; all processing happens on your device. See the Privacy Policy.
7. Disclaimer of Warranties
The app is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that segmentation or composition results will always match your intent, or that exported data will print without issue in every printing environment.
8. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any losses arising from use of or inability to use the app. Our total liability shall not exceed the amount you paid for the app in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including under the Japanese Consumer Contract Act.
9. Changes to the App or Terms
We may update the app and these Terms from time to time. Material changes will be reflected on this page with an updated effective date. Continued use of the app after changes take effect constitutes acceptance.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Japan, except where mandatory consumer-protection law provides otherwise.
11. Apple as Third-Party Beneficiary
You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple has no obligation to furnish any maintenance or support services with respect to the app; support is provided by us (see below).
